Polinizando en la Jornada de Ecologia Social en Ibague Tolima


Después de compartir con lxs jóvenes de Pavas, nos dimos una vuelta por Ibagué, Tolima. Fue la primera vez que una abeja a tenido la oportunidad de polinizar en el Tolima. La invitación fue para participar en una Jornada de Ecología Social con el proceso Desalambrando como parte de las preparaciones para el Carnaval por la Vida. Hubo estampado de camisetas con el siguiente mensaje "el agua vale + que el oro", presentaciones por grupos musicales y una presentación de Mesoamérica Resiste.


La socialización de Mesoamérica Resiste ayudó a conectar el contexto local con la amenaza de la empresa minera Anglo gold Ashanti y la mina de La Colosa con el modelo extractivista que existe en el mundo entero. Actualmente la aprobación de la mina está paralizada ya que a finales del año pasado el Consejo de Estado revocó la opción de consulta popular que se iba realizar sobre la mina, hasta el momento no han habido avances de ningún lado. Fue una visita demasiado corta pero como siempre, esperamos la próxima oportunidad de poder ir a compartir y polinizar con todx Tolimense que luche por defender su territorio y el río Yuma.


After sharing with the youth in Pavas we took a swing through Ibague, Tolima. It is the first time a bee has had the chance to come to Tolima a pollinate the graphics. The invitation was made to participate in a Social Ecology educational and cultural activity organized by the Desalambrando process and in preparations for the upcoming Carnival for Life.  There was silk screening of t-shirts with an image that said "water is worth more than gold", musical performances and a Mesoamérica Resiste presentation.


They sharing of Mesoamérica Resiste helped relate the threat of the mining company Anglo Gold Ashanti and the mine of  La Colosa within the context of the global extractivism model. Currently, as of late last year the approval of the mine has been paralyzed ever since the State Council revoked the possibility of a popular referendum that was in the process of happening regarding whether the mine would happen or not. Currently no side has had any advances. It was an all too short visit and hopefully next time we hope to continue to share and pollinate with the Tomlimenses that defend their territory and the Yuma river.

Act Now to Stop the Eviction of Afro-Colombians from Their Ancestral Lands in La Toma



The U.S. Network in Solidarity with Afro-Colombian Grassroots Communities (NASGACC) urges you to take action to prevent the eviction of Afro-Colombians from their ancestral territories in La Toma (Cauca). These communities’ ancestors established themselves in northern Cauca from the time they were forcibly enslaved and brought to Colombia in 1636. The descendants of these slaves have since carved out a living through artisanal gold mining and basic agricultural projects. Displacing these afrodescendants from their lands is not only a violation of their territorial and human rights but also an act that would lead to their impoverishment and devastation of their traditional culture.

The Afro-Colombian Community Council of La Toma was unofficially informed that they will be evicted from their ancestral territories on August 18th. As it stands the eviction will take place with the Colombian government and regional authorities not keeping its promises (see below) to the leaders of these communities. Late 2009, Colombia agreed before the Inter-America Commission of Human Rights (IACHR) that it would review the thirty-five mining permits it granted to third parties without the previous consent and consultation of the La Toma Community Council. The Regional Corporation of Cauca, the environmental authority for Cauca Department, stated that they would revoke environmental permits. Neither has taken place and no concrete actions were taken to respect the rights of Afrodescendant artisanal miners. While the Community Council has taken legal action to protect their rights, it has yet to receive a response from the authorities.

NASGACC is also concerned about the continued death threats against Afro-Colombian community council members and the human rights defenders that support them. Since April, a massacre of eight miners took place and others including Alex Quintero and Alex Gonzales. In recent weeks more killings of miners have taken place. These killings believed to be committed by paramilitaries that favor the displacement of local residents from the areas where the gold mines are situated follow a series of threats that were sent to community members, non-governmental organizations and the international group WOLA. While the government was scheduled to come up with a plan to protect La Toma community members by July 26th, it did not reveal a plan but rather put in place delay tactics to shirk responsibility further endangering the lives of civilians at risk of harm by paramilitaries.

We encourage you to contact your Member of Congress:

§ Urge him/her to take action to protect the territorial and human rights of Afro-Colombians in La Toma (Cauca). The eviction of Afrodescendants from La Toma should be halted and Colombian officials must implement all the steps they agreed to take at the December 2009 meeting. Your representative should contact the US State Department and recommend that they do not certify that the human rights conditions regarding aid to Colombia are being met. Such aid should not be certified until the threats and murders of Afro-Colombians in northern Cauca are investigated and perpetrators brought to justice.

§ Ask him/her to co-sponsor House Resolution 1224 on Afro-Colombian, Indigenous and Women IDPs.

-State officials should take action to guarantee the safety of Afro-Colombians at risk of harm in Cauca. They should call upon the Colombian authorities to halt the eviction of the community of La Toma, review the thirty five mining titles rejected by the community and the environmental licenses granted to third parties. State ought to ask the Colombian authorities to implement Order 005 on Afro-Colombians of which northern Cauca is an emblematic community and encourage them to dialogue with the Community Councils’ elected leaders on how best to implement this order in their community. Further, State should ask Colombia about the status of the investigation into the recent murders of Afro-Colombian leaders and threats made against the community councils in northern Cauca.

-State must ask the incoming Juan Manuel Santos Administration to take bold steps to dismantle the operational (military, economic and social) structures of the paramilitary groups in Cauca.

-State should be asked not to certify that military assistance is meeting the required human rights conditions.

Finally:

Write/email/call your local media (print and broadcast) and ask that they do more to cover the human rights abuses committed against Afro-Colombian communities. Please do the same with national media outlets by writing to their editors.

In December 2009, Colombian authorities met with Afro-Colombian leaders and agreed to do as follows:



Protection:

1) Leaders who are under threat that are currently outside of the areas will be given temporary relocation assistance. This assistance will be given the week of December 21st.

2) Colombian authorities will conduct a security risk analysis so that these leaders can return to the area (Cauca).

3) Authorities will be looking out for other requests regarding security involving other members and their families of these areas.

4) The community leaders requested that the Colombian authorities provide relocation assistance for the office of PCN that is currently situated in La Balsa de Santander de Quilichao. The authorities agreed to consider this request in January so that PCN can continue to work in this area of the country.

5) Authorities will put into place protocols for how they should respond to future emergencies concerning the physical security of leaders.



Persons responsible on the part of the authorities for carrying out the above: Diana Botero-PPDDH and Flor Romero of the Protection Unit of the Ministry of Justice.



Mining and Environment Titles:



1) The organizations will send the listing of land titles that violate the previous consultation process and law 70 of the black communities to the Ministry of Mines and Energy so that this Ministry can review them and respond in terms of whether or not such titles should be suspended and whether or not new titles need to be granted to the communities in question.

2) At minimum, the Ministry of the Environment will locate the environmental plan pertaining to Salvajina and review it to assess whether or not EPSA is violating the terms of the title when it comes to Afro-Colombians and Indigenous communities' right to previous consultation.



3) They will organize the next Regional Corporation for Cauca (mixed governmental and on-governmental environmental entity responsible for Cauca) meeting.

4) They will look for and send to the communities the information they are requesting in terms of how these communities can become involved in the environmental assessments made for the use of these territories.



Community Councils and Constitutional Court Order 005 on Afro-Colombian IDPs:



1) The community councils have asked that nine of the community councils that have requested their incorporation for the past two years (with little response) are in fact incorporated. These include the following community councils located in the municipality of Buenos Aires: Cerro Teta, Brisas del Rio Cauca and Alsacia. For the municipality of Suarez these include: La Toma, Asnazu, Las Brisas, Mindala and Las Mesetas and Robles. The authorities took note of this.

2) In terms of implementing the recommendations made in Constitutional Court Order 005 of January 2009 pertaining to internally displaced Afro-Colombians in the areas of Cauca in question, it was decided that the Direction for Afro-Colombian Affairs will respond the week of December 21 on what steps will be taken to implement this Order in this area of the country.



Investigations:



1) The Public Prosecutor for Human Rights will unify the various investigations that exist concerning threats against members of these communities into one case. This will be done internally by this entity in order to streamline the response.

2) The Public Prosecutor for Human Rights will decide who should be responsible for this investigation-whether it should be dealt with in Bogota or at the regional level in Cauca. The week of December 21st the authorities will decide this.

3) The authorities will provide periodic updates on how these investigations are going.

4) A person will be appointed to serve as the liaison between the communities and the Public Prosecutor for Human Rights.



Agreements and Responsibilities Directly Attributed to the Presidential Human Rights Program:



1) Starting the week of January 4th, Hermedis Gutierrez, official from the PPDDHH program in zone 2 will be present in the areas in question every 15 days. Mr. Gutierrez will be responsible for monitoring the threats against Afro-Colombians residing in the municipalities of Buenos Aires, Suarez and Morales.

2) In January, after the 12th, this entity will convene an internal meeting whereby a contingency plan will be developed. This plan will include a general analysis of the situation and steps that will be taken to deal with issues surrounding mining licenses, environmental plan for Salvajina, protection of these communities, formal recognition of the community councils, Constitutional Court Order 005 and investigations to be undertaken by the Public Prosecutor for Human Rights.

3) Carlos Franco discussed the security situation in these municipalities with Coronel Murcia. It was decided that the liaison for these communities concerning threats and security is Coronel Chavez. He is now the person in charge of monitoring the security situation in the area and attempting to clarify where the threats against the Afro-Colombian leaders originated, as well as the person responsible for addressing the presence of illegal armed groups in this region.

4) All new incidents concerning these communities will be directed to Remedís Gutierrez, Sandra Navaez, Diana Botero and Carlos Franco. These are the persons who should receive the information first. After these authorities received the information then the municipal human rights ombudsmen or PCN must send the information to the security forces in the area.

5) The communities' request for a community ombudsman in the area will be sent to the Human Rights Ombudsman.



The authorities have not fully complied with the above agreement and are now evicting Afro-Colombians from their lands.

Comunicado de La Toma sobre el desalojo

Hoy, 21 de Mayo del 2010, que se conmemora el día Nacional de la Afrocolombianidad el Consejo Comunitario del Corregimiento de la Toma denuncia la violación de derechos étnicos ancestrales territoriales consagradas en la constitucional nacional ley 70 y los tratados internacionales de la OIT y el auto 005 de la corte constitucional que hoy está cometiendo el gobierno nacional en cabeza de Ingeominas, Ministerio de Minas y Energía, Ministerio de Interior y Justicia, cuando otorgo títulos de concesión mineras a personas extrañas a la región tal es el caso de el titulo BFC 021 expedido por INGEOMINAS A el señor HECTOR DE JESUS SARRIA uno de los cuales quieren apoderarse del patrimonio de más de 7000 personas mineras, las cuales devenga el sustento económico de sus familias de este territorio. Instamos al gobierno nacional que derogue los títulos mineros y se dé el trámite correspondiente a la consulta previa y consentimiento previo libre e informado a las comunidades Afrodescendientes del Corregimiento de La Toma.


Por ello Rechazamos el desalojo programado en la vereda de la toma para el 4 al 18 de junio.


Como es posible que hoy nuestras comunidades tengan que salir a las vías a taponarlas como único medio de ser escuchados por el gobierno local regional y nacional, ya que las formas de dialogo han sido infructuosas; el gobierno desconoce los derechos adquiridos por más de 430 años de legado ancestrales.

Las comunidades afrodescendientes de La Toma que por más de tres siglos (desde 1635), vienen haciendo minería artesanal siendo los dueños ancestrales de los territorios, están siendo víctimas de las decisiones arbitrarias de un gobierno que responde solamente a los intereses de los poderosos y que no respeta la Constitución ni las leyes para salvaguardar la integridad de los territorios, del medio ambiente y los derechos de los grupos étnicos.

En el año 2002, sin la aplicación del derecho fundamental de la Consulta Previa y Consentimiento Previo Libre e Informado, el gobierno nacional entregó un titulo de explotación minera a Hector Sarria, forastero, ajeno a la comunidad, en la Toma, municipio de Suarez, Región del Norte del departamento del Cauca, en el área en que los mineros de las comunidades desarrollan su actividad de subsistencia. El día 13 de mayo los mineros son notificados el Alcalde ha dado orden al comandante de policía de Cauca, con copia al comandante de la policía de Suarez, para que realice el desalojo de los mineros en el día que tengan a bien determinar.

En notificación recibida hoy miércoles 19 de Mayo del 2010 se les informa a los mineros que la diligencia de desalojo esta para el próximo viernes 21 de mayo del 2010. ¡Qué ironía! El día en que por allá en el año 1851 se abolió legalmente la esclavitud. Un día en que los y las afrocolombianos/as conmemoramos el reconocimiento de algunos derechos. Pero, bueno! El mensaje es claro: La libertad y reconocimiento de los derechos a los afrodescendientes en este país es un asunto de retórica discursiva, de carnaval y de ver bailar a los negros para divertir al amo blanco.

Pero sin titubeos los mineros y la comunidad de La Toma plantean que no se dejan sacar de sus minas, que por el honor de los antepasados que lucharon por la libertad, que trabajaron la mina y aún les dejaron sus territorios y sus riquezas naturales como herencia, están obligados y obligadas hoy a luchar por defender lo que les pertenece y a no volver a ser esclavos en la propia tierra que los vio nacer y crecer y, que ellos le dejaran ese legado a sus hijos: es la única herencia que les quedará.

El Consejo Comunitario de La Toma ha denunciado el atropello que el gobierno nacional ha venido ejerciendo sobre las comunidades, violando el derecho a la Consulta Previa y Consentimiento Previo, Libre e Informado, incumpliendo el convenio 169 de la OIT, la ley 70 y su reglamentación y desatendiendo el auto 005 de la Corte Constitucional que ordena al Estado colombiano a proteger los territorios ancestrales de las comunidades. Adicionalmente, los lideres del Consejo Comunitario junto a otros lideres indigenas, afrocolombianos, sindicales y defensores de derechos humanos han sido sistemática y reiteradamente amenazados de muerto por parte de los paramilitares. El gobierno por su parte legitima la acción ilegal de concesión y las acciones violentas de intimidación y amenazas con su silencio publico, permitiendo que grupos al margen de la ley soporten sus amenazas en la defensa del gobierno y sus políticas.

Solicitamos a las organizaciones de derechos humanos que nos acompañen para que se detenga esta tremenda injusticia y esta vergonzosa ofensa a los derechos de un pueblo que por su propio trabajo adquirió las tierras que habita y que ha trasmitido su legado de dignidad y autonomía de generación en generación.

Exigimos al gobierno nacional que brinde las garantías de protección de los derechos humanos y el DIH del consejo comunitario de La Toma y de las comunidades del municipio de Suarez en general.

MASACRE ANUNCIADA EN ZONA MINERA DEL MUNICIPIO DE EN SUAREZ CAUCA

Santiago de Cali, 8 de Abril de 2010

Ocho mineros fueron asesinados por hombres armados que se trasportaban en dos vehículos y una moto, los hechos ocurrieron en el sitio conocido como “Alto de Ovejas” zona rural del municipio de Suárez, en el departamento de Cauca, sur de Colombia. El sitio donde ocurrió la masacre es la parte alta del río Ovejas y se llega por carretera en un recorrido de casi una hora y una hora a pie.

Las Organizaciones abajo firmantes quienes habíamos advertido la grave situación de conflicto social y armado que se vive en los municipios del Noroccidente del Cauca, en particular en los Municipios de Suarez, Morales y Buenos Aires, demandamos de manera perentoria explicación del Gobierno Nacional porque pese a las innumerables solicitudes de protección a las comunidades de la zona y del numeroso contingente militar y de policía que se encuentra en el área, los autores de esta masacre tuvieron toda la libertad de ingresar en el territorio cometer el hecho y salir impunemente.

Una misión de verificación, compuesta por el Proceso de Comunidades Negras PCN, la Asociación de Cabildos Indígenas del Norte del Cauca y la Asociación para la Investigación y Acción social NOMADESC se encuentra en la zona con el objetivo de ampliar la información. Lastimosamente ningún organismo internacional pudo acompañar esta comisión por lo cual solicitamos a ustedes pronunciarse por escrito a la mayor brevedad exigiendo al estado colombiano acciones inmediatas de prevención y atención para toda la población del noroccidente del Cauca. A su vez solicitamos al sistema de Naciones Unidas, realizar una visita de verificación a la zona lo más pronto posible. Por nuestra parte ampliaremos la información tan pronto se terminen las labores de la comisión de verificación en el territorio.

ANTECEDENTES

& nbsp; To dos ustedes recordaran las diversas denuncias que las comunidades afrodescendientes, Campesinas, indígenas y organizaciones de derechos humanos hemos efectuado ante la comunidad nacional e internacional acerca de la barbarie impuesta en la zona y del despojo al que han sometido a las comunidades que ancestralmente habitan el territorio. En la actualidad se siguen procesos jurídicos en contra de los responsables por acción y por omisión de los crímenes cometidos así mismo se investiga la responsabilidad de las multinacionales Unión Fenosa, Anglo Gold Ashanti, Smurfit kappa Cartón de Colombia y Cosigo Resources. Sin embargo pese a los ingentes esfuerzos de las comunidades para generar mecanismos de prevención y protección la situación de riesgo de los pobladores de la zona es inminente y la impunidad del 100%.

ACCIONES PARA PROTEGER EL TERRITORIO

1.- Noviembre 5 de 2010 Audiencia Situación de las Comunidades Afrocolombianas Indígenas y Campesinas del Norte del Cauca en la Comisión Interamericana de Derechos Humanos de la OEA en Washitong: Durante la audiencia se presentaron pruebas de la grave situación, vulnerabilidad y amenaza contra las comunidades mineras, campesinas e indígenas. Así mismo se denuncio la permanente violación a la Consulta Previa, libre e informada; la aplicación de los planes de manejo ambiental; la ley 70, legislación indígena y los incumplimientos a las directivas 004 y 005 de la Corte Constitucional. En dicha audiencia se solicito a los representantes del Gobierno Colombiano emprender acciones inmediatas de prevención y protección a las comunidades de la zona. Resultado: El gobierno a un no ha otorgado los mecanismos de protección anunciados ante los Comisionados de la Comisión Interamericana de Derechos humanos de la OEA. [1]

2.- Diciembre 10 de 2010 Audiencia Pública por la Defensa del Territorio, la Cultura y la Dignidad de las Comunidades Indígenas, Afrodescendientes y Campesinas del Noroccidente del Cauca: En la Audiencia Convocada por la Comisión de derechos Humanos del Senado de la República a Petición de las comunidades y de la Asociación NOMADESC, se efectuó una radiografía del conflicto, se detallaron los casos de violación a los derechos humanos y se presentaron las investigaciones sobre los posibles responsables de los crímenes cometidos. Las comunidades y organizaciones de derechos humanos advirtieron la presencia de actores armados en la zona un grupo autodenominado Águilas Negras al parecer responsable de la ola de amenazas que se desato desde el mes de Octubre de 2010. Adicionalmente se solicito revisar la legislación que beneficia a las multinacionales que hacen presencia en esta zona, en contra vía de los derechos de las comunidades. Resultado: Se encuentra en trámite la solicitud de información sobre las multinacionales que tienen concesiones en la zona actores armados, información sobre los resultados de las investigaciones por los crímenes que han ocurrido en la zona y reuniones de alto nivel con las instituciones del Estado. 3.- Enero 17 de 2010 Misión de Verificación de Acción Permanente por la Paz[3]: Una misión con 10 delegados de los Estados Unidos viajo a la zona y visito a las comunidades de Suarez, entre ellos las comunidades Afrodescendientes que se dedican a la minería artesanal en el corregimiento de La Toma y comunidades indígenas de Cerro Tijeras. Esta misión escucho a la población afectada. Resultado: Incidencia ante gobierno nacional para que proteja las comunidades y el territorio afectado por graves crímenes de lesa humanidad.

4.- Enero 27 de 2010 Delegación del Estado Español Misión de Verificación de la situación de derechos humanos en Colombia: Esta misión no viajo hasta el territorio pero en sus reuniones con los sectores sociales en la Ciudad de Santiago de Cali tuvo la oportunidad de conocer los testimonios del conflicto social y armado que se vive en el territorio, la vulnerabilidad en la que se encuentran las comunidades indígenas, afrodescendientes y campesinas que habitan la zona. Resultado: La delegación del Estado Español efectuó un pronunciamiento público en donde presentan sus conclusiones y propuestas frente a la situación. [4]

5.- Visita de la Experta Independiente de Naciones Unidas Sobre Cuestiones de Minorías comisionada para Minorías de Naciones Unidas GAY MACDOUGALL: Visto el Corregimiento la Toma del Municipio de Suarez, recorrió todo el territorio visito las minas y escucho las denuncias directas de las comunidades afro descendientes que habitan la zona de los líderes de la comunidad, los representantes de los Concejos Comunitarios y del Proceso de Comunidades Negras PCN y se comprometió a efectuar acciones de seguimiento sobre la grave situación de Violación de derechos Humanos y demandar del gobierno colombiano cumplimiento a las normas nacionales e internacionales de respeto de los derechos humanos. La Experta independiente efectuó la visita en Compañía del Sr. DANIEL ATCHEBRO, Coordinador en Cali de la Oficina en Colombia del Alto Comisionado de las Naciones Unidas para los Derechos Humanos y otros delegados de la Organización. Resultado: Al término de su visita la experta independiente emitió una declaración y advirtió que las autoridades tienen mucho por hacer para recuperar la confianza de estas personas e instó al Ministro de Defensa para que proteja a estas comunidades.[5]

Queda una vez más comprobado que no existe VOLUNTAD POLITICA del Gobierno nacional y de los organismos de protección para cumplir con las normas nacionales e internacionales de respeto a los derechos humanos. Es absolutamente preocupante que pese a los pronunciamientos de la comunidad internacional, las judicializaciones, denuncias, Audiencias, demandas, solicitudes etc., el Estado colombiano no haya brindado garantías para la vida de las comunidades.

Por lo anterior demandamos una vez más del Gobierno Nacional respuestas inmediatas a las comunidades acerca de la reiterada violación a los derechos humanos en particular sobre los lamentables hechos en los que perdieron la vida 8 mineros.

Update on La Toma / Actualizacion Sobre La Toma

Dear Friends and Advocates,

Thank you for your active response in solidarity with the Afro-Colombian grassroots Communities of La Toma. The eviction has been delayed. The community is in state of alert, and the Community Council will remain in Assemble until August 19 when they expect to meet with high rank authorities to discuss the situation.

So far, there has been no response from the Colombian authorities to the situation. As the Colombian government disregard the call of grassroots leaders, the international pressure is imperative to open Colombian authorities' ears to the La Toma situation. Please stay alert, we will keep you posted on further actions.

La comunidad permanece en estado de alerta y el Consejo Comunitario permanece en asamblea permanente hasta el 19 de Agosto cuando la comunidad espera reunirse con las autoridades nacionales para discutir la situacion.

Hasta el momento, las autoridades colombianas no han rspondido a la situacion de La Toma. Dado que el gobierno colombiano no presta mayor atencion al llamado de los lideres comunitarios, la presion internacional se hace imperativa, para abrir los oidos del gobierno colombiano ante la situacion de la Toma. Por favor mantengase alerta, les mantendremos informados sobre futuras acciones.

Dear Friends and Colleagues,

On Thursday, August 6, 2009 the Colombian government will evict 1502 families from the Community Council of La Toma, in the Norte del Cauca Region. The traditional miner families who had inhabited those lands since 1636 and live primarily from gold mining since then, have been declared "owners of bad faith" (poseedores de mala fe) for mining in an area that was given in concession by the government to foreigners, without previous consultation to the communities, and in violation of the Law 70 of 1993, the ILO Convention 169 and the Auto 005 from the Colombian Constitutional Court.

The Community Council of La Toma is comprised of five villages: Yolombo, Gelima, Dos Aguas, El Ato and La Toma. 6500 of its 7000 hectares have been asked in concession by the foreign mining company Anglo Gold Ashanti. As the Community Council of La Toma face displacement, other communities in the municipalities of Suarez, Buenos Aires and Santander de Quilichao will follow since the Ashanti (as people in the area know it) and Consigo Resort, another mining company, are looking for permanent license to exploit the gold in the region, leaving hundreds of traditional miner families with no source of living.

The Colombian government in its usual fashion has disregard for national and international laws, avoiding consultation with the communities previous to any concession over their lands and resources. The Black Communities Process-PCN is asking for immediate advocacy action to prevent the expulsion and further internal displacement of the traditional miners. Nuevas Amenazas hacia las comunidades negras del Norte del Cauca / New Threats against the black communites of the north of Cauca

THE PROCESS OF BLACK COMMUNITIES IN COLOMBIA PUBLICIZES THE FOLLOWING ACTS BEFORE THE NATIONAL AND INTERNATIONAL COMMUNITY:

OCURRENCES:

1. The north of Cauca, specifically the municipalities of Suarez & Buenos Aires, is inhabited by a population that is 70% Afro-Colombian. These descendents of past slaves who now subsist from agriculture & mining are communities that have been an example of the construction of a grassroots peaceful resistance for the entire country.

2. Many Afro Colombian leaders have sacrificed their lives and personal interests to help in the construction of a national project that would help create the reconciliation needed within our society but with respect for our differences.

3. The north of the Cauca is a geographically strategic area that historically was a transportation corridor and still is of utmost environmental and mining importance. These reasons have caused that the region often finds itself in constant dispute with legal and illegal armed actors in addition to the particular interests of the companies such as AngloGold Ashanti, Union Fenosa and numerous timber companies.

4. In the region their are numerous organizations that are parts of the Process of Black Communities in Colombia- PCN- such as: Communal Councils, women's organizations, victims' organizations, groups of communal action, agricultural organizations and mining cooperatives. These groups constitute an invaluable and active defense of human rights and the promoting of initiatives seeking to better the quality of life for Afro Colombians.

5. It is note worthy the long tradition of struggle of these communities that have been mobilizing for hundreds of years for the right to freedom, of the most recent struggles it is important to take into account:

* The fight against the Salvajina Dam because of its negative impacts towards local communities. Since created in 1986 there have been several broken promises from the government towards the communities.

* The process of prior consultation in regards to the EPSA project of the canalization of the River Ovejas to enlarge the Salvajina reservoir.

6. In 2004, derived from these struggles, the Integrated Inter Ethnic Commission is constituted by local delegates from indigenous and black communities in the municipalities of Suárez, Buenos Aires & Morales. This is done with the accompaniment of the Association of Indigenous Cabildos from the North of Cauca- ACIN and the Process of Black Communities- PCN.

7. All the implemented or planned mega development projects for the region have contributed to the forced displacement and the deterioration of the economic, environmental, social and cultural rights of local communities. This has also deepened the inequality that exists between the region's inhabitants and populations in other parts of the country.


WE DENOUNCE:

1. In June 2000 the Autodefensas Unidas de Colombia- AUC paramilitary group, took a public presence in the area of Buenos Aires and then Suarez. It maintained control of the area until 2004. As a product of this we have had a long history of massacres, selective assassinations, forced rationing of food, massive displacements, forced disappearances, the raping of women, and forced recruiting as some of the actions that were implemented against the population with the support of public security forces. One of the more well known massacres from the south of our country is one that happened in this territory, in Naya. In the case of Buenos Aires, these acts are part of a process of discussion and work around some pilot projects of collective reparations being promoted by the National Commission of Reparations and Reconciliation- CNRR. In spite of the previously mentioned acts, towards the end of 2007 there has been evidence of a paramilitary reorganization process in the region.

2. On October 9, 2007, 10 armed men from the Calima Bloc came to the residence of Clemencia Carabalí, member of The Municipal Association of Women of Buenos Aires –ASOM, located in the countryside of La Balsa, municipality of Buenos Aires. Clemencia, was interrogated for about 20 minutes about her personal activities. Clemencia, at this time was pregnant and the above mentioned encounter caused the death of her unborn child and forced her to relocate to the town of Santander de Quilichao where she remained for three months. When she returned to La Balsa, she was once again was forced to leave her home to go live in Santander de Quilichao in Feb. 2008 because of the frequent harassment from unknown individuals regarding her activities and where about.

3. In the month of May 2008 the compañero Robert de Jesús Guacheta was killed in the municipality of Morelos. He was the supplicant governor in his community and a member of the Inter Ethnic Commission.

4. The compañera Francia Elena Márquez, member of the Community Council for the countryside of La Toma in the municipality of Suárez is a dynamic youth organizer and member of the Association of Women of Yolombó and of the Inter Ethnic Commission has been subject to continued threats after her speaking in a communal hearing that was held with the government.

5. On May 29, 2009, in the office of the Municipal Association of Women located in La Balsa, an unknown man appeared asking for Clemencia Carabalí: "What has she been doing and where is she?" When the women said that she was not in the region, the man said that she better "take care of her family and mind her own business". A similar message was also left for the compañera Liliana Sandoval, also a member of ASOM, after he asked if she worked with Clemencia Carabalí. In the same way, various compañeras of ASOM have been threatened by means of phone calls on their cellular phones. All are asked if they work with Clemencia Carabalí and then they are told to take care of their families and to mind their own business.

These acts show that there is an insistent persecution against the relentless effort of peaceful resistance that these organizations do in defense of the communities' rights'. This persecution is brining drastic and irreparable consequences for the leaders of these organizations. From the intensification of the armed conflict in the regions inhabited by Afro descendent populations, the large number of assassinated leaders, family members and the more then one million people who are victims of internal forced displacement.

In recognizing the grave situation of the Afro descendent population in Colombia, the Constitutional Court regulated Auto 005 of 2009, in which it prioritizes the region of the North of Cauca, as an emblematic case in which there are specific orders that include:

* The Office of Social Action, in coordination with the territories it must design and put into action a specific plan for the protection and assistance of these communities, that must be functional by October 30, 2009.

* The Ministry of the Interior & Justice, must design no later then October 30, 2009, a plan to chart the collective and ancestral territories that are inhabited by the Afro-Colombian population.

* ORDERS that the Director of Social Action as coordinator of the National System of Attention to the Displaced Population, and CNAIPD, design a holistic plan for the prevention, protection and assistance of the Afro Colombian population. This must be done with full participation of the communities themselves and full respect of all selected authorities, those constituted and those from the respective territories. The Plan of Prevention, Protection and Assistance to the Afro Colombian population should be designed no later the January 18, 2010. The director of Social Action on July 1, 2010 should present a report regarding the advancement of the application of the holistic plan.

WE DEMAND:

1. The national government adopt the necessary measures to protect the lives of the leaders from the black communities of the municipalities of Suarez & Buenos Aires and the guarantee the right to a free, open and informative prior consultation, regarding any projects that would affect the communities' rights' and territory.

2. The local, departmental and national governments must protect as mandated the Colombian Law, the Convention 169 of the OIT and the Auto 005 of 2009, the right of black communities to remain in their territory. To comply; communities, organizations and leaders should be coordinated with to assure that the mechanisms and guarantees for the accomplishing of what is mandated by Auto 005 of 2009 and other measure related to the issue.

3. The government and the CNRR, adopt the necessary measures to guarantee the lives of the leaders, organizational members and communities that accepted to participate in the Pilot Program of Collective Reparation. Equally that measures be adopted that guarantee this exercise can advance without back track in regards of the right to autonomous participation of the communities, organizations and leaders.

4. We demand that the wave of threats, intimidation and assassination of community leaders and members of the Inter Ethnic Commission be investigated and that the appropriate measures be taken against those responsible.


El Proceso de Comunidades Negras –PCN urges the national and international community to demand that the Colombian government completely follow in compliance with the Auto 005 of 2009.
